Overview

Unlawful discrimination is either: a) unfair or unequal treatment of an employee based on a prohibited ground of discrimination; or (b) less favourable treatment of an employee based on a prohibited ground of discrimination. Prohibited grounds of discrimination are set by law and include, amongst a number of others, race, sex, pregnancy, disability and age. The discrimination tribunals have the power to award compensation, but most also have the power to reinstate an employee.
