Not genuine redundancy despite some jobs disappearing


When a genuine redundancy occurs and proper procedures are followed, an employee affected cannot bring an unfair dismissal action. In this case, the FWA found that the dismissals of ten mine workers could not be said to have arisen ‘because the employer no longer wanted the jobs performed by the workers performed by anyone’.
